These General Terms and Conditions of Sale rule the relations between purchaser-consumers of Services available online and BAINS DE SAILLON SA, a limited liability company incorporated under the laws of Switzerland, with its registered office at Route du Centre Thermal 16 1913 Saillon (Switzerland), holder of IDE CHE-108.116.411 and entered in the Commercial Register under the number CH-621.3.002.412-0.

Any purchase on the website performed within the scope of these General Terms and Conditions of Sale is subject to these conditions and entails the unreserved acceptance of these conditions, notwithstanding any provision to the contrary.

DEFINITIONS

Terms commencing with a capital letter within these General Terms and Conditions of Sale are to be interpreted as follows:

• "Purchaser": Consumer purchasing a Service permitting access to the Bains de Saillon complex;
• "Services": digital version of the Service permitting access to the Bains de Saillon complex;
• "Conditions": these General Terms and Conditions of Sale;
• "Consumer" refers to a natural person acting for purposes which are not within the scope of his commercial, industrial, artisanal or liberal activity;
• "Bains de Saillon": hotel complex, thermal center and theme restaurants in the heart of Wallis;
• "Website": the website of the Bains de Saillon, at www.bainsdesaillon.ch

SCOPE OF APPLICATION

These Conditions apply to the sale of Services to Purchasers on the Website.

On placing an order, the Purchaser acknowledges having read, understood and accepted these Conditions, without any reservations.

Each order placed following publication of the new version of the Conditions by Bains de Saillon is subject to acceptance of the latter.

SERVICES CATEGORIES

The various packages and their features are detailed on the Website.

PURCHASE OF SERVICES

To purchase one or more Services - for oneself or to be offered to a third party, the Purchaser must access the Website and complete the required fields to place an order.

By placing an order on this Website, the Consumer agrees to purchase the products he selected in accordance with these Conditions.

Orders placed on this Website may be subject to minimum or maximum quantity limits.

Once the transaction is finalised, the Purchaser receives a confirmation of purchase via email.

The orders placed on this Website do not constitute a binding contract until they have been confirmed via an email from Bains de Saillon. 

Bains de Saillon reserves the right to reject an order, in particular in the event of insolvency.

The data recorded by Bains de Saillon constitute irrefutable proof of the order or of the transaction. The data recorded by the payment system is irrefutable evidence of the financial transaction.

PRICE

The price of the Services, in Swiss francs and including all taxes, will appear on the Website at the time of placing the order.

The price of the Services is established on the basis of the applicable tax rates valid on the date of entry into force of the Conditions. It may be amended at any time in the event of alterations of these tax rates.

Bains de Saillon reserves the right to alter its prices at any time and to cancel a contract presenting wording, printing or calculation errors.

PAYMENT TERMS

The price of the Services purchased on the Website must be paid in full at the time of purchase.

SERVICES DELIVERY

The Services are delivered by mail to the mail address indicated by the Purchaser at the time of purchase.

AMENDMENT, EXCHANGE AND REFUND OF SERVICES

Services, even if unused, cannot be amended, exchanged or refunded.

The Conditions apply to any Services purchase as of 23 November 2017.

AMENDMENTS OF THE CONDITIONS

BAINS DE SAILLON SA reserves the right to perform amendments to the Conditions, as well as to the rate of the Services, in whole or partially, without prior notice. Such amendments shall become effective on the date specified in the Conditions.

PROCESSING OF PERSONAL DATA

Upon registration of the Purchaser on this Website, the accuracy and completeness of the mandatory data to be provided for the purchase of Services must be confirmed by the Purchaser.

Any change of address or contact details must be notified to Bains de Saillon.

Pursuant to the provisions of Articles 8 and 9 of the Federal Data Protection Act of 19 June 1992, personal data collected from a Purchaser shall be processed with the consent of the Purchaser, for the purpose of submitting commercial offers. The recipients of the data are BAINS DE SAILLON SA and BOAS Gestion SA, as well as, with the Purchaser´s consent, the commercial partners of BAINS DE SAILLON SA.

Anyone whose data has been collected, has the right to access, rectify and delete this data, which can be exercised by contacting BAINS DE SAILLON SA.
